Terms of Service

1. About ServoSimple

ServoSimple is a software-as-a-service platform operated by 33 Industries Pty Ltd (ABN pending) ("we", "us", "our"). ServoSimple provides workforce management tools for petrol station and convenience store operators in Australia. By creating an account and using ServoSimple, you agree to these Terms of Service ("Terms").

2. Eligibility

You must be at least 18 years old and have the authority to bind the business entity you register on behalf of. By accepting these Terms, you represent that you meet these requirements.

3. Account Registration

You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@servosimple.com if you suspect unauthorised access. We are not liable for losses arising from your failure to protect your credentials.

Each subscription covers the number of sites specified in your plan. You must not use ServoSimple for more sites than your licensed count without upgrading your plan.

4. Subscription and Payment

ServoSimple offers monthly subscriptions and a Lifetime Deal (LTD). All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.

• Monthly plans are billed in advance each month. If payment fails, access may be suspended after a grace period of 7 days.
• Lifetime Deal is a one-time payment granting perpetual access to the platform features available at time of purchase, plus all future updates released within the same product tier.
• All payments are processed securely by Stripe. We do not store your card details.
• Refunds are assessed on a case-by-case basis. Monthly subscribers may request a refund within 7 days of the first payment. LTD purchases are non-refundable after 14 days.

5. Acceptable Use

You agree not to:

• Use ServoSimple for any unlawful purpose or in breach of Australian law
• Attempt to gain unauthorised access to any part of the platform or other users' data
• Reverse engineer, copy, or resell the platform or any part of it
• Upload malicious code, viruses, or any content that could harm the platform or other users
• Use the platform to store or process data in a way that violates applicable privacy laws

6. Your Data

You retain ownership of all data you enter into ServoSimple (staff records, shift data, timesheets, etc.). You grant us a limited licence to store and process this data solely for the purpose of providing the service to you.

We will not sell your data to third parties. See our Privacy Policy for full details on how we handle your information.

Upon account termination, you may request an export of your data within 30 days. After 30 days, data may be permanently deleted.

7. Intellectual Property

ServoSimple, its design, code, and AI features are the intellectual property of 33 Industries Pty Ltd. Nothing in these Terms transfers any IP rights to you. You may not copy, reproduce, or create derivative works of any part of the platform without prior written consent.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime, outages, or service interruptions outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by Australian law, our total liability to you for any claim arising out of or related to these Terms or your use of ServoSimple is limited to the amount you paid us in the 12 months preceding the claim.

We exclude all liability for indirect, consequential, incidental, or special damages, including loss of profit, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under the Australian Consumer Law, including consumer guarantees.

10. Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or if we are required to do so by law. We will provide reasonable notice where possible.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of ServoSimple after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria. We encourage resolution of disputes through direct contact at support@servosimple.com before initiating formal proceedings.
